Terms & Conditions of Sale – Second-Hand Plant & Equipment

By purchasing any second-hand plant or equipment from us, you agree to the following terms and conditions:

1. Sales Are Final
   All sales are final. No refunds or exchanges will be offered under any circumstances, except where required under Australian Consumer Law.
2. Pick-Up Only
   All items are sold on a pick-up only basis from:
   80 Gillam Drive, Kelmscott, Western Australia.
   We do not offer delivery or freight services.
3. Condition of Goods
   All items are sold "as is" and "as described". It is the buyer’s responsibility to inspect the goods prior to purchase to ensure they meet requirements. No guarantees are made regarding fitness for purpose.
4. Inspection of Goods
   Inspections are strictly by appointment only or as listed on our website. Walk-in viewings will not be accommodated.
5. Payment Terms
   Full payment is required before any goods will be released. We accept payment via bank transfer, EFTPOS, or other methods as listed on our website. No items will be held without a deposit or payment confirmation.
6. Returns and Restocking Fee
   In rare cases where a return is accepted at our sole discretion, a 25% or $110 (whichever is greater) restocking and administration fee will apply. Returned items must be in the original condition and must be returned within a timeframe agreed upon at the time of sale. Transport costs for returns are the buyer’s responsibility and are non-refundable.
7. No Warranty
   No warranty or guarantee is provided unless explicitly stated in writing. All goods are second-hand and may show signs of wear, use, or age.
8. Ownership and Risk
   Ownership and all associated risk pass to the buyer upon full payment and collection of the goods.
9. Limitation of Liability
   We accept no responsibility for any loss, damage, or injury resulting from the purchase, possession, transport, or use of any item sold. Buyers accept all risks associated with use of second-hand equipment.
10. Governing Law
    These terms are governed by the laws of Western Australia. Any disputes will be subject to the jurisdiction of Western Australian courts.
11.  All prices are inclusive of G.S.T.
12.  Excludes government fees.
